PLEASE READ CAREFULLY: By creating an account, clicking "I Agree," or using the CorpFit App ("App"), you agree to be bound by these Terms. If you do not agree, you must not use this App.
1. The Service
CorpFit is a corporate wellness platform designed to help employees improve their fitness and well-being. We provide workout tracking, wellness content, and engagement challenges ("Services").
- Corporate Access: Your access is likely sponsored by your employer ("Sponsor"). If your employment or the sponsorship agreement ends, your access to the Premium features may be terminated.
- Non-Commercial Use: The App is for your personal, non-commercial use only.
2. Medical Disclaimer & Safety
CorpFit is NOT a medical device and does not provide medical advice.
- Consult Your Doctor: Always consult a physician before starting any new fitness program, especially if you have a history of heart disease, high blood pressure, or other medical conditions.
- No Diagnosis: The data provided by this App (e.g., heart rate, sleep quality) is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease.
- Emergency: If you experience dizziness, faintness, chest pain, or shortness of breath, STOP IMMEDIATELY and consult a doctor or call emergency services.
3. Assumption of Risk
You understand that physical exercise involves inherent risks of injury, ranging from minor strains to serious conditions.
- Voluntary Participation: You agree that your use of the App and participation in any workouts are purely voluntary.
- Release of Liability: To the maximum extent permitted by UAE law, you voluntarily assume all risks known or unknown associated with your use of the Service. You release Prime Vitality Consultancy FZ-LLC and its sponsors from any liability for injury, death, or property damage resulting from your use of the App, except where caused by our gross negligence.
4. Physical Activity Readiness (PAR-Q)
Mandatory Health Check:
- By using this App, you confirm that you have truthfully completed the Physical Activity Readiness Questionnaire (PAR-Q) presented to you during onboarding.
- If your health status changes (e.g., you develop a heart condition or undergo surgery), you agree to stop using the exercise features immediately and consult a physician.
- Failure to answer truthfully voids any liability protection you might otherwise claim.
5. Subscriptions, Free Trials, and Billing
We offer Monthly, Quarterly, and Yearly subscription plans. The payment method and cancellation rules depend on where you purchased your subscription.
5.1. Free Trials
- If you sign up for a free trial, you will not be charged during the trial period.
- Automatic Conversion: Unless you cancel at least 24 hours before the end of the trial, your payment method will automatically be charged for the full subscription price of the plan you selected (Monthly, Quarterly, or Yearly).
5.2. Purchases via App Stores (Apple App Store / Google Play)
If you subscribe through an App Store, your billing relationship is directly with Apple or Google.
- Payment: Charged to your Apple ID or Google Play account upon confirmation of purchase.
- Auto-Renewal: Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Cancellation: You must cancel directly through your phone settings (e.g., Apple ID > Subscriptions). Uninstalling the App does NOT cancel your subscription.
- Refunds: We cannot process refunds for App Store purchases. You must contact Apple or Google support directly.
5.3. Purchases via Web or Direct Billing
If you subscribe directly through our website or a corporate payment portal:
- Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle (Month, Quarter, or Year) until you cancel.
- Cancellation: You may cancel anytime by logging into your account settings on our website or by contacting support@superhuman.run. Cancellation will take effect at the end of the current billing period; you will not receive a refund for the remaining days.
- Price Changes: We reserve the right to change pricing with 30 days' notice. Continued use after the change constitutes acceptance.
5.4. Refund Policy and Cooling-Off Period
- Digital Content Waiver: By subscribing and immediately accessing the premium content (workouts, videos), you acknowledge that you are receiving the service immediately. Therefore, you expressly waive your right to a "cooling-off" period or refund under UAE Consumer Protection Law once the digital content has been accessed.
- Exceptions: Refunds may be considered only where the Service is technically defective or unavailable for an extended period, at the Company's sole discretion.
6. User Conduct
You agree NOT to:
- Post abusive, harassing, or illegal content in community challenges.
- Attempt to hack, reverse engineer, or disrupt the App's servers.
- Share your account credentials with others.
- Use the App for any commercial solicitation or spam.
We reserve the right to suspend or ban your account immediately if you violate these rules.
7. Data Privacy & Employer Sharing
Your privacy is critical. Our data practices are governed by our Privacy Policy.
- What your Employer Sees: We generally share only aggregated, anonymized data with your Sponsor (e.g., "Team A completed 50 workouts").
- What stays private: We do not share your specific health data (e.g., weight, specific medical conditions) with your employer without your explicit additional consent.
8. Intellectual Property
All content, videos, code, and designs in the App are the property of Prime Vitality Consultancy FZ-LLC or its licensors. You are granted a limited, revocable license to use the App for your personal wellness. You may not copy, distribute, or sell any part of the App.
9. Governing Law & Dispute Resolution
- Jurisdiction: These Terms are governed by the laws of the United Arab Emirates and the regulations of the Ras Al Khaimah Economic Zone (RAKEZ).
- Disputes: Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre (DIFC) (Small Claims Tribunal for claims under AED 500,000), or the Courts of Ras Al Khaimah, at the Company's discretion.
